Privacy Policy

At Trail See we recognize that privacy is important. This Privacy Policy (“Policy”) sets forth how Trail See, Inc., and/or its subsidiaries or affiliated companies (collectively, “Trail See”) protect a User’s’ privacy when using any of the Trail See mobile applications, websites or other products, services, and/or websites offered by Trail See (collectively, “Services”). By using the Services, you agree to be bound by the terms of this Privacy Policy and you further agree that we may store and transmit your information within the United States in accordance with the terms herein.

IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, PLEASE DO NOT ACCESS OR USE THE SERVICES. Trail See reviews its policies from time to time, and reserves the right to make changes, without prior notice. We will post changes on this page, or other places reasonably calculated for you to see them, such as the Service’s home page. If we make any material changes that may impact your personally identifiable information, we may notify you by e-mail or other approved means. Your continued use of our Services after we have posted any changes indicates your agreement to the changes.

This Privacy Policy is intended to describe for you the information we collect, how that information may be used, with whom it may be shared, how you may access the information you provide us, and your choices about such uses and disclosures.

Information Collection

Trail See collects both "personally identifiable information" and "non-personally identifiable information" about our users, depending upon the level of Services the User accesses. Our primary purpose of collecting information from you is to provide you with the Services. When you provide personal information to us, the information may be sent to our servers located in the United States.

Personally Identifiable Information Collected

Personal information is information that identifies you as an individual, (“personally identifiable information”), and which can be used to contact you. Trail See collects several types of personally identifiable information that you provide us while using these Services, including when you register an account or purchase a subscription membership. Trail See may collect the following types of personally identifiable information, directly or indirectly, when you use our Services: all information entered into an account registration, whether or not submitted, such as your name, email address, birth date, and a password; billing and financial information if you purchase any paid Services, which may include your physical address, telephone number, credit card or other account payment information; information about your computer, mobile device and carrier such as IP addresses, if applicable; profile data, profile pictures or URLs, gender, biographical data in any profiles, user ID numbers of you and your friends, SNS login email addresses, physical location of you and your device, and other applications you use; and any and all information you post to our Services, such as through chats, forums, messages, posts, as well as information you send us when seeking customer assistance or technical support.

Some of the Services include location-based features. For these Services, Trail See and our partners and licensees may collect, use and share a User’s precise location information, including the real-time geographic location of a User’s mobile device. For some third-party partners, such as Google, this location information will be shared automatically. For others, such as Facebook, this information will only be shared with a User’s explicit permission or if you choose to share it. Location information includes, but is not limited to, any information we derive in order to identify a User’s geographic position. This information may be collected from a User’s wireless carrier, certain third party service providers, or directly from the mobile device that the User previously registered for use with Trail See. The collection and tracking of a User’s location information may occur even when the Trail See mobile phone application is not actively open and running. Location information is only displayed and shared in accordance with the User’s established privacy settings.

Non-Personally Identifiable Information Collected

We use various technologies to collect non-personally idenfitiable information from your mobile device and/or computer and about your activities and usage of our Services. For example, we collect and store usage statistics on the Service, click paths as well as other data that you may provide in surveys, demographic information including gender, age, zip code, information about your computer, hardware, software, mobile device, including unique device IDs or other device identifiers, incident data, IP address, MAC address and connection. This information is generally collected through cookies, log files, clear gifs (.web beacons.), mobile device software development kits, other tracking technologies, and from third parties who may provide us with supplemental information, including users who allow us access to their contacts or address books, which information we link to other information. Log Files collects technical information from your browser that is automatically collected when you access our Services. This information includes your IP address, your browser type, operating system, access times, the content of any undeleted cookies that your browser previously accepted from us (see "Cookies" below), and the referring website address.

Cookies

A cookie is a piece of data stored on a User’s computer that tracks non-personally identifiable information about the user. When using our Services we, or third party service providers acting on our behalf, may assign your computer or mobile device one or more cookies which enable us to improve the quality of our Services and to personalize your experience. Cookies allow us to automatically collect non-personally identifiable information about your activity, such as the web pages you visit, the links or advertisements you click, or the other actions you conduct while using our Services. The cookies do not store any personally identifiable information about you; however, we may link cookies to personally identifiable information such as your user id, which we store internally. Most browsers automatically accept cookies, but you can usually modify your browser setting to disable cookies. If you choose to disable cookies, you will still be able to use our Services, but you may not be able to use all of the features and functionality we offer. Third party companies advertising in our Services may also use cookies or other technologies, and those practices are subject to their own policies.

Web Beacons/Tracking Pixels

We, or our advertisers, may use standard Internet technology such as web beacons (or. clear gifs.), tracking pixels and other similar technologies, to gather aggregate, non- personally identifiable information about your use of our Services. We also may include web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon. This allows us to gauge the effectiveness of our marketing efforts and the quality of our Services.

How We Use Information We Collect

We may use the personally-identifiable information we collect through our Services in order to provide any of the following services:

  • deliver the products or services you have requested;
  • create your account;
  • allow access to our Services and all of its features;
  • Employ “reverse geo-coding” and a User’s IP address, or saved location information to provide Users with specialized route and event content;
  • provide you with customer/technical support and to solicit feedback;
  • deliver advertising tailored to your interests or background;
  • communicate with you by email, postal mail, telephone, and/or mobile devices about updates, new products or services, or promotional offers;
  • perform data and statistical analysis on use of the Services;
  • enforce our Terms of Service; and
  • perform any other functions otherwise described to you at the time we collect the information.

Information collected by us may be added to our databases and used for future emails or postings regarding the Services and our other products or services. Some email messages may include your name and profile photo. We may also send you promotional e-mail messages and promotional SMS messages ("Promotional Communications") directly or in partnership with third parties. We may record and store archives of Service communications on our servers for User safety and protection. You acknowledge and consent to the recording and storage of such communications for these purposes. You further agree to receive push notifications and email notifications regarding the Services.

To better serve Users and improve the Services, Trail See may conduct research on User demographics, interests and behavior based on the personally identifiable information and other information provided to Trail See. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregated information with our affiliates, agents and business partners. This aggregate information does not identify a User personally. Trail See may also disclose aggregated information in order to describe our Services to current and prospective business partners, and to other third parties for other lawful purposes.

Sharing Information We Collect

The following describes when and how we will share your information, which may include personally identifiable information, with third parties. We will provide your information to third party companies to perform services on our behalf, including payment processing, data analysis, e-mail delivery, hosting services, customer service and to assist us in our marketing efforts. All third party providers agree to maintain the confidentiality of your information and to not use it for any purpose other than to provide services on our behalf. Certain personally identifiable information that a User discloses and/or transmits, such as User name and any profile picture, as well as non-personally identifiable information, may be disclosed or accessible to the general public at any time, and could be read, collected, and/or used by third parties, including other Users, including in ways unknown to Trail See. Trail See is not responsible for any use of a User’s personal or location information by any third party. Trail See therefore recommends that User carefully manage and routinely confirm the privacy settings, to prevent unauthorized use or abuse of User’s personally identifiable or location information by others.

Unless you give your consent, we do not directly share personally identifiable information with third party advertisers for their marketing purposes. We may share aggregated information (i.e., not specifically identifiable to you); anonymous information; and certain technical information (including IP Addresses, MAC Addresses for mobile devices and mobile device IDs) to develop and deliver targeted advertising in the Service and on the websites of third parties. We may also allow advertisers to collect these types of information within the Service and they may share it with us. The information collected may be used to offer you tailored advertising in order to personalize your user experience, and to analyze web traffic and other end user activity to improve your experience. Our collection, use, and disclosure of anonymous or aggregated information are not subject to any of the restrictions in this Privacy Policy.

We may share any information we collect in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from any law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us in our sole discretion. In addition, we may disclose your information when we believe, in our sole discretion, it is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity (suspected or actual), suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms of Service or other agreements or policies. If Trail See is involved in a merger, acquisition, sale of its assets in whole or part, or other change of ownership or control, we may transfer all of your information, including personally identifiable information, to the successor organization. You will be notified if such change will result in any material changes to this Privacy Policy.

Third Party Advertisers and Links

Please be advised that advertisers or third party websites that have links in our Services may also collect personally identifiable information about you. Third party advertisers may use tracking technologies, such as cookies, to collect information about users who view or interact with their advertisements and connect to other websites. This information allows us, and our business partners to deliver targeted advertisements and gauge their effectiveness. Trail See does not control those third parties or their websites. The information practices of third party advertisers and linked websites are not covered by this Privacy Policy, and you assume sole risk and responsibility for reviewing and agreeing to any applicable third party privacy policies.

Excluded Information

This Privacy Policy shall not apply to any unsolicited information a User provides to Trail See, including without limitation, information posted to any public areas of the Trail See Services, such as community forums (collectively, “Public Areas”), any ideas for new products or modifications to existing services, trail information or maps uploads, and other unsolicited submissions (collectively, “Unsolicited Information”), including all User Content, as that term is defined in our Terms of Service, that by its nature is accessible or intended to be accessible to other Users of the Services. All such Unsolicited Information shall be deemed to be non-confidential and we shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

Updating Or Obtaining Your Information

You can update or modify some information by accessing the “Settings” feature in the applicable Service on your mobile device. To modify, correct, change, update or remove your information from Trail See’s database, click here or send your request via email to: support@trailsee.com. Requests will be processed within thirty (30) days. Trail See will retain records relating to payments or customer service matters for legal and accounting purposes. If you have sent or posted content on the Service, we may not be able to delete it.

Special Notice to California Residents: Trail See will not share any personally identifiable information about you with other companies to the extent prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law. California residents may, no more than once per calendar year, request information about our disclosures of certain categories of personal information to third parties for direct marketing purposes. To be valid, requests must be submitted to us at support@trailsee.com. Within thirty days of receiving this request, we will provide a list of the categories of personal information disclosed for direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of the third parties.

Children's Privacy

Trail See will never knowingly collect any personally identifiable information about children under the age of 13. If we obtain actual knowledge that we have collected personally identifiable information about a child under the age of 13, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties. Our Services are not targeted to audiences under the age of 13. IF YOU ARE UNDER THE AGE OF 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SERVICES AT ANY TIME OR IN ANY MANNER.

Security

Trail See uses commercially reasonable security measures to help safeguard personally identifiable information in our possession against unauthorized access, loss, alteration, disclosure, or use. Of course, despite these measures, we cannot guarantee perfect security of the Services or any networks, systems, servers and databases we operate or that are operated on our behalf. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personally identifiable information, searches, or other communications will always remain secure.

Visitors Outside the United States

This Privacy Policy is intended to cover collection of information on our Services from residents of the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By visiting or using our Services, you acknowledge and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this privacy policy, regardless of the laws of your residence country.
